ՀՀ արդարադատության նախարարությունը հայտարարություն է տարածել ՄԻԵԴ-ում ՀՀ դատավորի մրցույթում առաջադրված թեկնածուների անձնական տվյալների մասին տեղեկություններ տրամադրելու մասին: Հաղորդագրության մեջ, մասնավորապես, ասված է.
«Մարդու իրավունքների եվրոպական դատարանի դատավորի պաշտոնում Հայաստանի Հանրապետության կողմից առաջադրվող թեկնածուների ընտրության մրցույթում հաղթող ճանաչվածների ցուցակը հաստատելու մասին» Հայաստանի Հանրապետության Նախագահի 2014 թվականի հոկտեմբերի 13-ի ՆՀ-543-Ա հրամանագիրը Հայաստանի Հանրապետության Նախագահի 2015 թվականի հունվարի 12-ի ՆՀ-2-Ա հրամանագրով ուժը կորցրած է ճանաչվելու կապակցությամբ հայտնում ենք, որ Եվրոպայի խորհրդի նախարարների կոմիտեի Մարդու իրավունքների եվրոպական դատարանի դատավորի ընտրության համար թեկնածուների վերաբերյալ փորձագետների խորհրդատվական խմբի (այսուհետ՝ Խորհրդատվական խումբ) հարցմանն ի պատասխան, Հայաստանի Հանրապետության արդարադատության նախարարությունը դեռևս 2014 թվականի նոյեմբերին Հայաստանի Հանրապետության արտաքին գործերի նախարարության միջոցով Խորհրդատվական խմբին տրամադրել է լրացուցիչ տեղեկատվություն ներպետական մրցույթում հաղթող ճանաչված թեկնածուների վերաբերյալ, նրանց կենսագրությունները և թեկնածուների ընտրության ընթացակարգի նկարագրությունը:
Խորհրդատվական խումբը ներկայացված տեղեկատվության վերլուծության արդյունքում՝ ելնելով Մարդու իրավունքների եվրոպական դատարանի դատավորին ներկայացվող անձնական և մասնագիտական բարձր որակական հատկանիշների վերաբերյալ պահանջներից, Հայաստանի Հանրապետության կողմից Եվրոպայի խորհրդի խորհրդարանական վեհաժողովին ներկայացվելիք դատավորի երեք թեկնածուների վերաբերյալ կարծիք է հայտնել առ այն, որ թեկնածուներից երկուսը՝ Արայիկ Ղազարյանը և Արմեն Հարությունյանը, բավարարում են Մարդու իրավունքների եվրոպական դատարանի դատավորին ներկայացվող պահանջն երին:
Անդրադառնալով Հանձնաժողովի կողմից սեռերի ներկայացվածության սկզբունքի կիրառման արդյունքում թեկնածուների ցուցակում ընդգրկված Նելիկ Հարությունյանին՝ Խորհրդատվական խումբը նշել է, որ վերջինիս մասնագիտական որակավորումներն և փորձը հաշվի առնելով՝ հիշյալ թեկնածուն Եվրոպական կոնվենցիայի 21-րդ հոդվածի 1-ին մասի իմաստով չի կարող համարվել բավարար ճանաչում ունեցող իրազեկ իրավագետ, ինչը պահանջվում է Մարդու իրավունքների եվրոպական դատարանի դատավորից:
Հարկ է նշել, որ Խորհրդատվական խմբի կարծիքը Մարդու իրավունքների եվրոպական դատարանի դատավորի պաշտոնում Հայաստանի Հանրապետության կողմից առաջադրվող թեկնածուների ընտրության ընթացակարգին վերաբերող որևէ դիտողություն չի բովանդակում:
Հայտնում ենք, որ Մարդու իրավունքների եվրոպական դատարանի դատավորի պաշտոնում Հայաստանի Հանրապետության կողմից առաջադրվող թեկնածուների ընտրության մրցույթի հետագա ընթացքի վերաբերյալ կտրամադրվի լրացուցիչ տեղեկատվություն»:
