«Այս պահին չկա՞, այո՞, հարուցված քրեական գործ ՀՀ իրավապահների կողմից՝ տվյալ անձի՝ ՀՀ պետական սահմանն ապօրինի հատելու փորձի վերաբերյալ»: Նման հարցով այսօր Ազգային ժողովում Գյումրիում տեղի ունեցած սպանության հարցով կազմակերպված խորհրդարանական լսումների ժամանակ Զարուհի Փոստանջյանը դիմեց ՀՀ գլխավոր դատախազ Գևորգ Կոստանյանին:
«Եվ հենց դա է երևի պատճառը, որ ՀՀ քննչական կոմիտեի կողմից երեկ չհայտարարվեց, որ մենք նաև այդ հիմքով ենք մեղադրանք առաջադրել տվյալ անձին: Միայն հայտարարվեց, որ ՀՀ իրավապահների կողմից միայն սպանության գործով է մեղադրանք առաջադրվել: Որպես ՀՀ գլխավոր դատախազ՝ ինչո՞ւ եք սպասում քննարկումներին, մինչդեռ ակնհայտ է, որ ռուս սահմանապահներն են նրան վերցրել արգելանքի տակ, ձերբակալել, երբ պարտավոր էին ղեկավարվել ՀՀ քրեական, քրեական դատավարության օրենսգրքով: Մենք չգիտենք՝ տվյալ անձը Պերմյակո՞վն է, թե՞ ոչ, որովհետև նա չի եղել զինվորական հագուստով, չի ունեցել փաստաթղթեր: Ռուսական կողմը հայտարարեց, որ իրենք վերցրել են արգելանքի տակ, տեղափոխել 102-րդ ռազմաբազա: Եթե ռուսական կողմը նրան վերցրել է, ապա մեր ԱԱԾ-ն պետք է մասնակից լիներ դրան, որովհետև կարող է Պերմյակովը չէր, մեկ այլ անձ էր: Կան իրավախախտներ: Իրավախախտ է՝ ՌԴ ներկայացուցիչները, որոնք թույլ են տվել ապօրինի փոխանցում տվյալ անձին և որոնց նկատմամբ չունենք քրեական գործ: Մյուսը՝ մեր ԱԱԾ ներկայացուցիչներն են, որոնք թույլ են տվել անգործություն, չեն փոխանցել մեզ, հետաքննչական գործողությունները չեն կատարել, այս առումով ևս պետք է հարուցվի քրեական գործ»,- հայտարարեց Փոստանջյանը՝ հավելելով, որ եթե քրեական գործ չի հարուցվել, ապա ինքն այս պահին հաղորդում է տալիս հանցագործության մասին ու խնդրում ընթացք տալ:
Պատգամավորին ի պատասխան՝ Գևորգ Կոստանյանն ասաց. «Այս հանգամանքը, որ նշեցիք, այն անհրաժեշտ իրավական հիմքերն են, որ պետք է ունենամ, որ դիմեմ փոխանցման համար: Մենք պետք է քննարկենք՝ ա) արդյոք օրինակա՞ն, թե՞ ապօրինի ճանապարհով է հայտնվել ռուս սահմանապահ զինվորականների իրավազորության տակ, բ) արդյոք օրինակա՞ն, թե՞ ապօրինի ճանապարհով է հանձնվել 102-րդ ռազմաբազայի տրամադրության տակ: Այս բոլոր փաստերն ունենալու դեպքում կունենամ բավարար հիմք, որ իմ պահանջը ՌԴ գլխավոր դատախազին լինի հիմնավորված, ոչ թե զուտ պահանջ, զուտ դիմում: Այ, ձեր ասած հանգամանքները պարզելու արդյունքում, երբ ձեռք կբերենք ապացույցներ, կդիմենք»:
Զարուհի Փոստանջյանը տեղից ճշտող հարց հնչեցրեց, թե նշանակում է, որ մեզ համար պարզ չէ՞:
«Պարզ լինելը, ակնհայտ լինելն այլ է, փաստն այլ է: Քննության արդյունքում պարզ կլինի՝ ով ինչ պարտավորություններ ուներ, որը չի կատարել: Այս ամենը պարզելու արդյունքում համապատասխան պատասխանատվության հարց կբարձրացվի սուբյեկտներից յուրաքանչյուրին: Եվ սա բավարար կլինի, որ իմ դիմումը ՌԴ գլխավոր դատախազին լինի պատճաբանաված»,- պատասխանելով՝ ասաց Կոստանյանը:
