Մարդու իրավունքների եվրոպական դատարանում ավարտվել է թուրք ազգայնական գործիչ Դողու Փերինչեքի գործով լսումները: Դատավարությանը ծավալուն ելույթ է ունեցել ՄԻԵԴ-ում ՀՀ ներկայացուցիչ, ՀՀ գլխավոր դատախազ Գևորգ Կոստանյանը։ ՀՀ գլխավոր դատախազի ելույթը ներկայացնում ենք ամբողջությամբ:
«Պարո՛ն նախագահող, հարգելի դատավորներ, պատիվ ունեմ դիմել Ձեզ որպես Հայաստանի Հանրապետության կառավարության ներկայացուցիչ:
Ուղիղ հարյուր տարի առաջ Օսմանյան կայսրությունը նախաձեռնեց հայ ժողովրդի լայնածավալ ու համակարգված ոչնչացումը: Այս տարի ապրիլի 24-ը առանձնահատուկ նշանակություն ունի. այդ օրը նշվում է ոճրագործության հարյուրամյակը. բայց ոչ այն պատճառով, որ կոտորածներն ու աքսորները տեղի են ունեցել միայն այդ օրը: Ոչ, դրանք տևել են 25 տարուց ավելի՝ 1895-1923թթ.: Բայց 1915 թվականի այդ օրը նախապես պլանավորված և ցինիկ կերպով թուրքական իշխանությունները հավաքեցին բոլոր հայ մտավորականներին՝ հարյուրավոր գրողների, երգահանների, արվեստագետների, համայնքային ղեկավարների և սպանեցին նրանց:
Հայ տղամարդիկ, որոնցից շատերն, ի դեպ, ծառայում էին օսմանյան բանակում, սրի քաշվեցին: Կանայք, երեխաներն ու ծերերը ուղարկվեցին անապատ՝ մահվան քայլերթի, որտեղ նրանք սովի մատնվեցին, խոշտանգվեցին, բռնաբարվեցին և սպանվեցին: Կանխամտածված կերպով ոչնչացվեց հայ բնակչության կեսից ավելին:
Այս հիշողության կսկիծը շարունակում է ապրել հայերի սրտերում ու մտքերում: Նրանք, ում հաջողվեց փրկվել, հաճախ նախանձում էին մահացածներին՝ տեսնելով այն ինչ կատարվում է: Նրանք զրկվեցին ամեն ինչից՝ ընտանիքից, սեփականությունից, մշակութային և հոգևոր ժառանգությունից: Նրանք, ում հաջողվեց խուսափել տեղահանությունից, նախանձում էին հեռացածներին, քանի որ իրենք կորցրեցին ավելին՝ զրկվեցին հայկական ինքնությունից՝ տասնյակ տարիներ ապրելով վախով, որ կարող է բացահայտվել իրենց հայ լինելը: Ապրեցին փոխված անուններով, բռնի ուժով փոխված հավ ատքով՝ իրար գաղտնի զգուշացնելով չբարձրաձայնել հայերեն խոսքը, որ կարողացել էին պահպանել:
Հայ ժողովուրդը փրկվեց և հաղթահարեց. մենք երբեք չենք խնդրել այս դատարանին խոսել տանջանքների մասին, որոնց ականատես են եղել ոչ միայն անհատները, այլև համայնքներն ու ողջ ազգը: Բայց հայ ժողովուրդը չէր էլ սպասում, որ հարյուրամյակի նախաշեմին կհայտնվի այս դատարանում՝ փորձելով պաշտպանել սեփական պատմությունը կույր ժխտողականությունից, չէր սպասում, որ այս դատարանը երբևէ հնարավորություն կընձեռի ժխտողականներին ապահով հանգրվան ունենալ իրենց հայտարարությունների համար, որոնք արդեն այսօր օգտագործվում են պատմությունը խեղաթյուրելու քարոզչական նպատակներով:
Որպես ներգրավված կողմ, Հայաստանի դերն է մատնանշել այն ճշգրիտ սկզբունքները, որոնցով պետք է լուծվի այս գործը, ինչպես նաև ընդգծել այն սխալները, որ տեղ են գտել ստորին պալատի վճռում: Կարևոր է ոչ այնքան դատարանի հետևությունը, որքան դատարանին ներկայացված փաստերի անճշտությունը, իրավական և տրամաբանական սխալները, որոնք բարենպաստ պայմաններ ստեղծեցին ցեղասպանությունը ժխտողների համար ողջ աշխարհում: Մենք այստեղ ենք ապահովելու նման սխալների կրկնության բացառումը մի դատարանի կողմից, որ հանդես է գալիս հանուն մարդու իրավունքների:
