Երևանի բնակիչ Արշավիր Բարսամյանի սպանության դեպքի առթիվ Երևանի քննչական վարչության Աջափնյակ և Դավիթաշեն վարչական շրջանների քննչական բաժնի վարույթում քննվող քրեական գործով մեղադրանք է առաջադրվել երեք անձի։
ՀՀ քննչական կոմիտեի տեղեկատվության և հասարակայնության հետ կապերի բաժնից տեղեկացնում են, որ նախաքննությամբ պարզվել է, որ ՀՀ քաղաքացի Բ.Երիցյանն իր կնոջ հետ 2015 թվականի հունվարի 31-ին' ժամը 10:00-ին, Ռ.Մկրտչյանի կողմից շահագործվող ավտոմեքենայով Հրազդան քաղաքից եկել է Երևան՝ հանդիպելու Երևանի բնակիչ Ա.Բարսամյանին։
Նախկինում ունեցած գույքային վեճի շուրջ Ա.Բարսամյանի բնակարանում ծագած վիճաբանության ժամանակ, նախաքննության նյութերի համաձայն, Բ.Երիցյանը մուրճով հարվածներ է հասցրել տանտիրոջ գլխի և դեմքի տարբեր մասերին։ Ստացած հարվածների հետևանքով վերջինս ընկել է մահճակալին և օգնություն կանչել։
Հնարավոր դիմադրությունը կանխելու նպատակով կինը մարմնով ընկել է տուժողի վրա, բռնել նրան, իսկ Բ.Երիցյանը շարունակել է մուրճով հարվածներ հասցնել՝ այդպիսով Ա.Բարսամյանին դիտավորությամբ զրկելով կյանքից:
Քննությամբ պարզվել է նաև, որ սպանությունից հետո հանցագործության հետքերը թաքցնելու նպատակով Երիցյան ամուսինները և վարորդը, ում ավտոմեքենայով եկել էին Երևան, դիակը տարել են նշված բնակարանի խոհանոց՝ նկուղում թաքցնելու համար, սակայն իրենց կամքից անկախ հանգամանքներով հանցագործության հետքերը չեն կարողացել թաքցնել, քանի որ հանցանքի կատարման պահին բռնվել են ոստիկանության աշխատակիցների կողմից:
Ձեռք բերված ապացույցների համակցությամբ՝ Երիցյան ամուսիններին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 2-րդ մասի 7-րդ կետով ( խմբի կողմից կատարված սպանություն), իսկ վարորդին՝ 334-րդ հոդվածի 1-ին մասով (հանցագործության պարտակում)։
Մեղադրյալների նկատմամբ որպես խափանման միջոց կալանավորումը կիրառելու վերաբերյալ միջնորդությամբ քննիչը դիմել է դատարան, որի քննարկման արդյունքում դատարանը Բ.Երիցյանի նկատմամբ որպես խափանման միջոց է կիրառել կալանավորումը՝ երկու ամիս ժամանակով, վերջինիս կնոջ նկատմամբ որպես խափանման միջոց է կիրառել կալանավորումը՝ մեկ ամիս ժամանակով։ Իսկ ծանր հանցագործությունը պարտակելու մեջ մեղադրվող Ռ.Մկրտչյանի նկատմամբ որպես խափանման միջոց կալանավորումը կիրառելու մասին միջնորդությունը դատարանը մերժել է, ուստի՝ քննիչը նրա նկատմամբ ընտրե լ է խափանման միջոց ստորագրությունը չհեռանալու մասին։
Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով' դատարանի' օրինական ուժի մեջ մտած դատավճռով:
