Արաբկիր և Քանաքեռ-Զեյթուն վարչական շրջանների ընդհանուր իրավասության դատարանում Լևոն Ավետիսյանի նախագահությամբ շարունակվեց Աշոտ Մնացականյանի և Արսեն Մաթևոսյանի գործի դատական քննությունը:
41-ամյա Աշոտ Մնացականյանը և 34-ամյա Արսեն Մաթևոսյանը մեղադրվում են խմբի կազմում խուլիգանական դրդումներով սպանության փորձ և որպես զենք օգտագործված առարկաների գործադրմամբ խուլիգանություն կատարելու համար՝ ՀՀ քրեական օրենսգրքի 34-104 հոդվածի 2-րդ մասի 7-րդ և 258 հոդվածի 4-րդ մասի 7-րդ կետերով:
Ըստ մեղադրանքի՝ 2013 թվականի նոյեմբերի 28-ին, ժամը 20-ն անց 40-ի սահմաններում Վաղարշյան փողոցում գործող «Պարմա» առևտրի կենտրոնի մոտ ամբաստանյալները հանդիպել են տուժող Արմեն Փ.-ի հետ, որպեսզի պարզաբանեն, թե ինչու է Արմենը զանգահարել իր նախկին կնոջը՝ Աշոտ Մնացականյանի ընկերուհի Նոնային (անունը փոխված է):
Ըստ մեղադրական եզրակացության՝ Արմեն Փ.-ն ու նրա նախկին կին Նոնան ամուսնալուծվել են: Արմենը նորից է ամուսնացել, մեկնել է ԱՄՆ:
Դեպքից առաջ նա եկել է Հայաստան, ցանկացել է հանդիպել Նոնային, որ վերցնի ամուսնական մատանին:
Գնացել է Նոնայի շենքի մոտ, տեսել է, որ Նոնան իջնում է Աշոտ Մնացականյանի մեքենայից: Արմենը երկու անգամ զանգել է նախկին կնոջը: Երկրորդ անգամ զանգին պատասխանել է Աշոտ Մնացականյանը:
Վերջինս պարզել է, թե ով է զանգողը, և «Պարմա» առևտրի կենտրոնի մոտ տեղի է ունեցել Արմեն Փ.-ի հետ հանդիպումը:
Առաջադրված մեղադրանքի համաձայն՝ առևտրի կենտրոնի մոտ Աշոտը, Արսենը, ևս երեք հոգի՝ խմբի կազմում, հայհոյանքներ են տվել Արմեն Փ.-ի հասցեին, որպես զենք օգտագործված առարկաների գործադրմամբ՝ բռունցքներով, ոտքերով, ձեռքերով, սուր ծակող գործիքով սպանելու դիտավորությամբ բազմաթիվ հարվածներ են հասցրել տուժողին, մինչև որ նա կորցրել է գիտակցությունը:
Այդ հանգամանքը, ինչպես նաև առևտրի կենտրոնի հաճախորդների դիմադրությունը պատճառ են դարձել, որ խմբի անդամները դիմեն փախուստի և իրենց կամքից անկախ՝ սպանությունն ավարտին չհասցնեն՝ ըստ մեղադրանքի:
Մեղադրական եզրակացության ձևակերպմամբ՝ ամբաստանյալները, մեկը մյուսի գործողությունները գիտակցելով ու լրացնելով՝ հարվածներ են հասցրել տուժողին, գոռացել են, թե սպանում են նրան:
Երբ տուժողը, արնաքամ լինելով, փորձել է մտնել առևտրի կենտրոն ու փրկվել, ամբաստանյալների ընկերներից մեկը հետևից բռնել է տուժողին, իսկ Արսեն Մաթևոսյանը հյութով լի ապակե շշով հետևից հարվածել է տուժողի գլխին:
Շիշը ջարդվել է, տուժողը այդ հարվածից վնասվածքներ է ստացել ու վայր է ընկել:
Մաթևոսյանը, ըստ մեղադրանքի, ոտքերով հարվածել է ընկածին ու գոռացել է՝ մեռի:
Մեղադրող դատախազ Կարապետյանը հրապարակեց մեղադրական եզրակացության եզրափակիչ մասը, և ամբաստանյալներն ասաց, թե մեղադրանքը չեն ընդունում, իրենց մեղավոր չեն ճանաչում: Մաթևոսյանը շեշտեց. «Ընդհանրապես»:
Դատական նիստին ներկա չէր 38-ամյա տուժողը: Նրա ներկայացուցիչ, փաստաբան Մելքոնյանը հայտնեց, որ Արմեն Փ.-ն վիրահատվել է, ներկայումս հետվիրահատական վերականգնողական շրջանում է, նշանակվել է տնային ռեժիմ՝ երեք շաբաթով: Ա. Մելքոնյանը ներկայացրեց իր հայտարարությունը հաստատող բժշկական փաստաթուղթ և ասաց նաև, թե առաջիկայում տուժողին ևս մի վիրահատության են ենթարկելու՝ կապված դեպքի ժամանակ ստացած վնասվածքների հետ:
Դատարանը սահմանեց ապացույցների հետազոտման կարգ՝ կհարցաքննվեն վկաները, տուժողը, կհետազոտվեն գործում առկա այլ ապացույցները, կհարցաքննվեն մեղքը չընդունող ամբաստանյալները:
Այս գործով համառորեն չեն ներկայանում վկաները: Նրանք, ովքեր պատշաճ ծանուցվել, բայց դատարան չէին ներկայացել, հաջորդ նիստին դատարան կբերվեն ոստիկանների կողմից: Դատարանը վեց վկայի վերաբերյալ կկայացնի բերման ենթարկելու որոշում:
Դատական հաջորդ նիստը տեղի կունենա մարտի 11-ին:
